We do not intentionally collect sensitive or special-category data. However, the personal stories voluntarily shared by Customers for the creation of a Custom Song may, in some cases, contain emotionally sensitive content (e.g., references to deceased loved ones, family events, health-related circumstances). By submitting such information, the Customer expressly consents to its processing for the sole purpose of producing the requested Custom Song.

3. How We Collect Information

We collect your information when you:

  • Place an order on our Site (including personal stories and details submitted for Custom Song orders)
  • Create an account or profile
  • Subscribe to our newsletter or marketing emails
  • Participate in a survey, giveaway, or promotion
  • Contact customer service
  • Browse or interact with our ads and website through cookies, analytics, and tracking pixels
  • Submit modification requests, feedback, or written validations regarding Custom Song deliveries

  • Communicate with the Customer regarding the production, delivery, and validation of the song
  • Maintain internal records of the order for legal, accounting, and support purposes

The personal stories and content provided for Custom Song creation are not used for marketing purposes, are not publicly shared, and are not used to train artificial intelligence models without the Customer's explicit prior consent.

6. Sharing Your Information

We share your personal data only when necessary to operate our business, with:

  • Payment processors (e.g., Stripe, PayPal) for secure transaction processing
  • Shipping and logistics providers for order delivery and returns
  • Marketing platforms (e.g., Klaviyo) for opt-in newsletters and campaigns
  • IT and infrastructure partners (e.g., Shopify, analytics tools, hosting providers)
  • AI-assisted creative production tools and audio generation platforms used to assist in the creation of Custom Songs. These third-party tools process the lyrics and creative briefs strictly for the purpose of producing the audio file requested by the Customer. We select providers that offer adequate data protection guarantees and, whenever possible, do not retain Customer data after processing.
  • Legal authorities if required by law, subpoena, or court order

All service providers are contractually obligated to protect your data and use it only for authorized purposes.

We do not sell, rent, or otherwise commercially distribute the personal stories, names, or content submitted by Customers for Custom Song orders.

7. International Data Transfers

We operate globally and may transfer personal information outside the United States. When doing so, we ensure that adequate safeguards are in place, such as:

  • Standard Contractual Clauses (SCCs) approved by the European Commission
  • Data Processing Agreements with our vendors
  • Compliance with recognized international privacy frameworks

This includes data transfers that may occur when Custom Songs are produced using AI-assisted tools and audio generation platforms hosted in jurisdictions outside the European Union or the United Kingdom.

8. Data Retention

We retain your personal information:

  • For as long as necessary to fulfill your order or provide services
  • For the period required by law (e.g., tax or accounting purposes)
  • Until you request deletion, when applicable

For Custom Song orders, we retain the personal content submitted (stories, names, lyrics) and the final audio file for a reasonable period after delivery (typically up to 24 months) in order to:

  • Provide customer support, re-delivery, or technical assistance if needed
  • Comply with legal, tax, and accounting obligations
  • Resolve any disputes or chargeback claims

After this period, or earlier upon valid request from the Customer, the personal content and audio files are securely deleted or anonymized, except where retention is required by law.

SAIKI LLC will delete its own retained copies of the submitted content and audio file in accordance with this Policy and applicable law.

  • Third-party processing: To create the Custom Song, SAIKI LLC may rely on third-party audio generation, lyrics-assistance, and AI-assisted creative production tools. These third parties process the submitted content strictly under our instructions and for the sole purpose of producing the song.
  • No public disclosure: SAIKI LLC does not publish, share publicly, or use as testimonial the personal content submitted for a Custom Song order without the Customer's explicit prior consent.
  • Customer responsibility: By submitting personal information, names, or stories that involve third parties (e.g., a partner, child, family member, friend), the Customer warrants that they have the right and authority to share such information for the purpose of creating the Custom Song.
  • Retention and deletion: See Section 8 for retention periods and Section 9 for deletion rights.

13. SMS / MMS Text Message Marketing Program Privacy Policy

Your privacy is extremely important to us. We will only use the information you provide through our SMS/MMS Program to transmit your mobile messages and respond to you when necessary. This may include sharing information with platform providers, mobile carriers, and vendors who assist us in the delivery of such messages.

We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or customer information collected through the SMS/MMS Program to any third party.
