General Terms and Conditions of Sale With My Love – SAIKI LLC Version dated: May 1, 2026
These General Terms and Conditions of Sale (hereinafter referred to as the "Terms") govern the relationship between SAIKI LLC, a company registered under the laws of the State of Wyoming, United States (EIN: 37-2182998), with a registered address at 8245, 1021 E Lincolnway, Cheyenne, WY 82001, USA, and any individual consumer (hereinafter referred to as the "Customer" or "Buyer") purchasing products through the website with-my-love.com (hereinafter referred to as the "Site").
By confirming their order, the Customer accepts these Terms in full. These Terms take precedence over any other documents or terms issued by the Buyer.
1. DEFINITIONS
Buyer: Any natural person purchasing for purposes unrelated to professional or commercial activity.
Order: The purchase of one or more products via the Site.
Personal Data: Any information that can identify a natural person directly or indirectly.
Products: Items offered for sale by SAIKI LLC via the Site, including physical goods (such as books and journals) and personalized digital products (such as custom songs).
Custom Song: A bespoke digital audio creation produced specifically for the Customer based on the personal information, story, and preferences provided at the time of purchase.
Price: Total amount due including taxes and potential additional costs (e.g., shipping).
User: Any visitor to the Site.
2. PURPOSE
These Terms define the rights and obligations of both parties in relation to the sale of Products on the Site. They apply worldwide unless otherwise specified and may be updated at any time by SAIKI LLC. The applicable version is the one in effect at the time of the order.
3. ORDERS
3.1 Order Process
Customers select their Products, add them to their cart, enter shipping details (and, where applicable, the personal information required for personalized or custom-made Products), accept these Terms, choose a payment method, and confirm their order. Validation of the order constitutes a binding agreement between the Customer and SAIKI LLC.
3.2 Order Modification
Once confirmed, an order may only be modified if it has not yet been shipped or, in the case of custom digital Products, if production has not yet begun. Requests must be sent to customer support at hello@with-my-love.com.
3.3 Order Refusal
SAIKI LLC reserves the right to refuse or cancel any order in the following cases:
- Payment issues or chargeback disputes
- Ongoing dispute with the Buyer
- Suspicion of fraud, abusive behavior, or unusual order quantities
- Violation of these Terms
4. PRODUCTS
4.1 Product Information
Product descriptions, photos, and content on the Site are as accurate as possible but are provided for informational purposes only. Slight variations may occur, particularly for handcrafted or personalized items.
4.2 Availability
Products are offered subject to stock availability. In case of unavailability, the Buyer will be informed promptly and may choose between a refund or an alternative item.
4.3 Personalized and Custom Digital Products
Some Products offered on the Site, including but not limited to Custom Songs, are produced specifically for each Customer based on personal information provided at the time of purchase. These Products are unique, non-returnable by nature, and subject to specific conditions detailed in Section 11 of these Terms.
5. PRICES & INVOICING
Prices are displayed in U.S. dollars (USD) unless otherwise stated and include applicable taxes where required. Shipping, customs, and additional service fees may apply depending on the destination.
The Buyer is responsible for any customs duties or import taxes applicable in their country. Invoices are sent via email and may also be accessed through the customer account.
6. PROMO CODES
Promo codes are non-refundable, non-transferable, and cannot be exchanged for cash. Unless specified otherwise, they are valid for single use only and expire on the indicated date. Expired promo codes cannot be reinstated under any circumstances.
7. PAYMENT
Payments are due at the time of order confirmation. All transactions are processed securely via Stripe, PayPal, or other authorized payment providers. The Customer's payment method is charged immediately upon order confirmation. SAIKI LLC does not store full payment details; all processing is handled by trusted third-party gateways.
8. DELIVERY
8.1 Delivery Areas
SAIKI LLC ships internationally, including the United States, Canada, the United Kingdom, Australia, and most European countries. Delivery options, carriers, and estimated timelines are displayed at checkout.
8.2 Delivery Responsibility
The Buyer must ensure that all shipping details provided are accurate. Costs resulting from incorrect or incomplete addresses, refused shipments, or unclaimed packages shall be borne by the Buyer. Responsibility for the goods transfers to the Buyer once the carrier takes possession of the shipment.
8.3 Delivery of Digital Products
Custom Songs and other digital Products are delivered electronically to the email address provided by the Customer at the time of purchase. Estimated delivery timelines are indicated on the Product page at the time of order. The Customer is responsible for providing a valid and active email address and for ensuring that messages from SAIKI LLC are not blocked or filtered as spam.
9. OWNERSHIP
All Products remain the property of SAIKI LLC until full payment has been received and cleared. For Custom Songs and other personalized digital Products, ownership and usage rights are granted to the Customer for personal, non-commercial use only, upon full payment and final validation of the Product. Any commercial use, public broadcasting, resale, or redistribution is strictly prohibited without prior written consent from SAIKI LLC.
10. RETURNS & REFUNDS (PHYSICAL PRODUCTS)
The Buyer has 30 days from receipt to request a return or refund for physical Products (excluding personalized, custom-made, or digital items, which are governed by Section 11).
To initiate a return, the Buyer must:
- Contact support at hello@with-my-love.com
- Return the item(s) unused, in their original condition and packaging
- Cover the cost of return shipping
Returns must be sent to the address provided by the customer service team. If a return affects eligibility for a promotion (e.g., free shipping or bundle discounts), SAIKI LLC reserves the right to deduct related benefits from the refund.
Refunds will be processed to the original payment method once the returned item has been received and inspected.
11. CUSTOM SONG ORDERS — SPECIFIC TERMS
Custom Songs produced by With My Love are bespoke digital creations made specifically for each Customer, based on the personal information, story, and preferences provided at the time of purchase. Due to their unique, personalized, and non-returnable digital nature, Custom Song orders are strictly non-refundable, including in cases where the Customer changes their mind, no longer wants the song, or is dissatisfied with the creative result.
However, SAIKI LLC is committed to delivering a song the Customer loves. For this reason, the following free modification options are offered within a limited window after delivery:
- Partial modification — adjustment of a specific part of the song (e.g., a verse, a chorus, a transition, or a section of the audio)
- Style modification — change of the musical style, genre, tempo, instrumentation, or overall mood
- Lyrics modification — partial or complete rewriting of the lyrics
- Full regeneration — generation of a completely new version from scratch if the song does not meet expectations
11.1 Modification Window — 48 Hours
Modification requests must be sent to hello@with-my-love.com within 48 hours of receiving the initial song delivery. Beyond this 48-hour period, the song will be automatically considered as validated, final, and accepted by the Customer, and no further modifications, refunds, exchanges, or credits will be granted under any circumstances.
11.2 Maximum Number of Exchanges
To ensure a fair and efficient creative process, each Custom Song order is entitled to a maximum of three (3) total exchanges between the Customer and the SAIKI LLC team, structured as follows:
- First delivery — the initial version of the Custom Song
- Second delivery — a revised version after the first modification request
- Third and final delivery — a final revised version after the second modification request
Once the third version has been delivered, the order is automatically considered final and validated, regardless of the Customer's level of satisfaction. No additional modifications, regenerations, refunds, or replacements will be granted beyond this point.
11.3 Explicit Validation
If the Customer explicitly validates the song in writing (via email or any other written confirmation) at any stage of the process, the order is immediately considered final and definitive. No further modifications, regenerations, refunds, exchanges, or credits will be granted after explicit validation, even if the 48-hour window or the three-exchange limit has not yet been reached.
11.4 Acceptance of Specific Terms
By placing a Custom Song order, the Customer acknowledges and accepts the specific terms set out in this Section 11, which override any general return or refund conditions mentioned elsewhere in these Terms.
12. LIABILITY
The Buyer is responsible for ensuring that the Products are suitable for their intended use. SAIKI LLC shall not be held liable for damages resulting from misuse, improper handling, or failure to follow usage instructions. For Custom Songs, SAIKI LLC shall not be held liable for the Customer's subjective satisfaction with the creative outcome, provided that the agreed-upon modification process described in Section 11 has been made available.
13. FORCE MAJEURE
SAIKI LLC shall not be liable for any delay or failure to fulfill its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, strikes, pandemics, shipping disruptions, technical failures of third-party services, or supplier failure.
14. INTELLECTUAL PROPERTY
All Site content, including text, visuals, graphics, trademarks, and logos, is the exclusive property of SAIKI LLC or its licensors and is protected under U.S. and international intellectual property laws. Unauthorized reproduction, distribution, or use is strictly prohibited.
Regarding Custom Songs: the underlying compositions, recordings, and final audio files remain the intellectual property of SAIKI LLC. The Customer is granted a personal, non-exclusive, non-transferable, and non-commercial license to use, listen to, and privately share the delivered Custom Song. Any commercial exploitation, public broadcasting, monetization (including on streaming platforms or social media advertising), resale, or modification of the Custom Song is strictly prohibited without prior written consent from SAIKI LLC.
By providing personal information, stories, names, or other content used in the creation of a Custom Song, the Customer warrants that they have the right to share such information and grants SAIKI LLC the necessary rights to produce and deliver the Custom Song.
15. PERSONAL DATA
SAIKI LLC processes personal data in accordance with its Privacy Policy, available on the Site. By placing an order, the Buyer consents to the collection and processing of their data as outlined therein.
16. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. In case of a dispute, the parties shall first attempt to resolve it amicably. If no resolution is reached, disputes shall be submitted to the exclusive jurisdiction of the courts located in Cheyenne, Wyoming (USA).
17. SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS
We offer a mobile messaging program (the "Program"), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and our Privacy Policy (collectively referred to as the "Agreement"). By opting in to or participating in any of our Programs, you accept and agree to these terms, including your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the "Dispute Resolution" section below.
This Agreement is limited to the Program and does not modify other Terms and Conditions or Privacy Policies that may govern the relationship between you and us in other contexts.
The Program allows users to receive SMS/MMS mobile messages by affirmatively opting in — for example, through online or application-based enrollment forms. Regardless of how you opt in, this Agreement applies to your participation. By joining the Program, you consent to receive automated or prerecorded marketing messages at the phone number provided. You acknowledge that consent is not required to make any purchase. While some messages may be sent using an automatic telephone dialing system ("autodialer"), this shall not imply that all messages are sent via such means.
If you wish to stop receiving messages, reply STOP to any of our text messages. You may receive one final message confirming your opt-out. You understand that this is the only reasonable method of opting out. Requests made verbally or by sending other words will not be recognized as valid opt-out methods.
Message frequency may vary, and consent is not a condition for purchase. The Program involves recurring messages, and additional communications may occur based on your interaction with us.
You must have your own wireless device capable of two-way messaging, use a participating mobile carrier, and be the account holder (or have authorization from the account holder) to enroll. Standard message and data rates may apply depending on your mobile plan and carrier. Carriers are not responsible for delayed or undelivered messages.
We reserve the right to modify or terminate the Program, in whole or in part, at any time without notice. To the extent permitted by law, we may suspend or cancel your participation if we suspect misuse, fraud, or violations of these terms.
